if the family was on their own property then they had every right to be where they were and the landscaper was obligated to work around them.

just because he has work to do does not give him the right to press ahead at any cost, especially when there are bystanders present.

if he approached them prior to doing anything and they refused he should have skipped that portion or came back at another time and once he reached over that fence and started attacking that woman it now becomes assault and people have the right to defend themselves and keep him under raps until the police arrived.

once he did what he did there was no way he could justify what he did and since he got caught and got his azz beat he is trying to play himself as a victim to try and weasel out of getting in trouble for his actions which initiated the whole situation.

i would take my chances in the court room because there is no way he is walking away without a beating if he did that to my family member.

I think they should have punched him in the face a few more times and pulled the trimmer out of his hands and used it on him. F#cking @sshole. You get what you get when you pull idiotic sh!t like that. If he did that to one of my family members he would have taken a beating just to see how he likes it.

I agree but most normal people would leave the area until he finished. As I said something else is going on here. I am not saying I would not have done the same thing as the husband if that was my wife, however according to the law I could be punished just as much as the guy that hurt my wife.

Now that said I would have left the job and canceled the contract as soon as I could for that customer if the neighbor was being a pain in the @$$. It is not worth going to jail or hurting someone for.

i agree with you 100%, i am just looking at it from the viewpoint that even if the homeowner is being uncooperative that it is their right and as a contractor you must oblige.

it definitely sucks when a homeowner next door pulls that on you and most of us have either dealt with that or will deal with that at one time or another but in the end they have more rights then the contractor does and when you do something insane like that dude did then all bets are off.

I'm not going to choose any sides yet.

Watching the video, and reading the story on the page there is just confusing.

From the footage, I can understand why he would raise his trimmer up (not the best method), there was growth all along the fence that he was probably trying to cut. The women felt the need to walk over and put her arm over the fence?

Where were they sitting, right beside the damn fence?

Also, I'd like to see the trimmer he used. I'm trying to imagine why debris would fly into the neighbors yard from those angles.

I have a feeling that these neighbors do not get along with each other, and that this family maybe wanted to cause trouble and take their frustrations against the landscaper. (this is common, I'm sure we can all agree)

Scenario that I am considering

The landscaper was doing his job.

The neighbors told him to stop, probably because they didn't want to hear the noise, and wanted to enjoy their time - they couldn't wait 5 minutes. They are probably envious that their neighbor had a landscaper to begin with.

The landscaper probably thought that the neighbors were ignorant, so he didn't bother to listen, he went right back to work. The landscaper wanted to get this simple job done, so he can finish his day without having to come back when the neighbors weren't home.

The wife (neighbor) is a woman. She thought it would be clever to stop the landscaper and have her way, like most women do - by reaching over the fence and pushing the trimmer.

Suddenly she realized what she had done was stupid, so her family panicked and came up with a phony plan telling the police that debris were hitting them, and that's why they told him to stop.
