Smile Terms within Contract

Just something I'm working on...

Quote:
The client understands that their payment(s) must be made out to, and received by BATMAN on the payment due date(s) which have been specified above. If the clients payment(s) have not been received on time, BATMAN will postpone any or all of its services for the client. The client may be charged an additional late fee which must be combined with their current overdue balance.

BATMAN will never modify its weekly date of arrival to any property for the client. The weekly date of arrival may only be modified by the owner of BATMAN, and only if the modification will improve the overall efficiency within the company.

BATMAN will to the best of its abilities provide weekly lawn maintenance service for the client, which includes mowing of the lawn at a height of no less than two and a half (2.5) inches, trimming of edges and around obstacles, and blowing of debris.

The clients lawn must be clear of activity upon the arrival of BATMAN. To ensure proper service, the client must also remove toys, construction debris, garbage, and dog feces from the lawn.

If BATMAN dose not like these payment(s) he can go pound sand at any time, The Client will postpone any or all other payments as he see's fit. BATMAN may be charged trespassing if he comes to my door to try and collect.
BATMAN is to wear a modified cape and jump suit weekly upon arrival to the clients property for the clients entertainment . Once BATMAN'S arrival he may be asked by the owner to dance the Hula on the front yard, and only if the client approves will he write a check to the company.

BATMAN will do his best Hula weekly on the front lawn of the client, which includes grass skirt no less than two and a half (2.5) inches above the knees, trimming of edges with obstacles, found blowing in the street.

The clients must not laugh at these activity until BATMAN has left to ensure proper Hula service, the client must also remove any debris, garbage, and feces left on the lawn once BATMAN is gone .

Scott,

What is your view on why you feel this is necessary? It's possible other members of the forum don't know what you are dealing with, so they might not understand the reason behind all this.

I'll try and add why I feel what I had written is necessary.

I'm not entirely sure if I will use the above, considering I will most likely decline service right away if it has not been paid for. It's basically there to just show that if they are past due, I want more money. I don't want to charge the same amount for a lawn that has had weeks to grow, know what I mean? ... Now that I look it over, I still come off as an a-hole when writing a contract... LOL

It seems as though whenever rain is in the forecast, I get bombarded with phone calls requesting for me to bump the clients ahead of schedule. It gets extremely annoying considering it's basically impossible, and I end up looking like a bad person.

This is pretty standard, just explains the the client what our service includes...

This is my way of saying, "please for the love of God, leave me alone while I work" in a formal way. I also feel pretty upset when I arrive to a lawn that looks like a junkyard, my standards are not so low that I will be the one to pick up after them.

^ That basically sums it up, I'm still thinking of what to change around, add, or remove. Pretty tricky. Worst part is, I have to translate it to French after... frig.. lol

maybe something like this

In order to keep prices down batman needs to be paid on time

batman mows lawns weekly and there are many factors that play into timing of service and can not take requests for time/day of service

For safety please have lawn clear of toys Batman many damage items...

Batmans insurance will not let him work around people "for safty"

OBLIGATION from the customer is as follows: Mowing $32 per week, payable(To BATMAN) monthly via US mail. During a drought, the customer obligation will remain the same to the end of the service agreement.

I need a solid "Refund Policy".

The way I have it set up, is that clients must submit 3 post-dates cheques to pay for the entire season. (5.5 months divided into 3 cheques).

I would like to have something similar to, "Refunds are only accepted prior to the date your cheque(s) are deposited". Meaning, once a cheque has been deposited, there is nothing you can do.

This would save me tons of trouble, rather than trying to calculate how much I'd have to give each client back every time. I'm not necessarily charging per visit, so it would make refunds a little complex.

The reason why I don't want to seem as though I charge per visit, is because that's when clients will want refunds. If it rains, I get stuck paying the client back? Frig that, you can't run a business that way.

Here we go;

The client understands that chèques which have been deposited by BATMAN are non-refundable.

Scott, do you think you would enjoy it better if you just had a handful of large commercial customers to deal with versus home owners?
